All rights are reserved. You do not have any right, interest or title in or to the Material unless otherwise expressly indicated.

The trademarks, service marks, and logos (“Trade Marks”) contained on or in this Website or any other Jazz Site are registered and owned by Jazz. Save as expressly stated, you do not have any right to use, copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit or disseminate the Trade Marks without the prior written consent of Jazz.

You are permitted to print or download extracts of the Material for your personal use only provided that each copy contains a notice that the Material is owned by or licensed to Jazz. None of the Material may be used for any commercial or public use.

Save as expressly stated or as necessary to view, print or download extracts of the Material for personal use, none of the Material may be copied, edited, varied, reproduced, published, displayed, distributed, stored, transmitted, commercially exploited or disseminated in any form whatsoever without the prior written consent of Jazz.

3. Content Submitted To The Website

Information, data, text, music, software, sound, photographs, graphics, video, messages or other materials may be posted, emailed or uploaded (in public or privately) on to designated areas of this Website. Any information, data, text, music, software, sound, photographs, graphics, video, messages or other materials which are posted or uploaded on to this Website or any other Jazz Site or otherwise transmitted through this Website or any other Jazz Site by any visitor to this Website is referred to as “Content”. Jazz does not control the Content and, as such, is not responsible for it in any way whatsoever. In particular, Jazz does not guarantee the accuracy, integrity or quality of such Content. Jazz shall have the right (but not the obligation) in its sole discretion to delete, edit, lock, move or remove any Content without notice. Without limiting the foregoing, Jazz shall have the right without notice to record the IP address from which any Content is posted or uploaded to or otherwise transmitted through this Website or any other Jazz Site and to lock or remove any Content which violates these Terms and Conditions or is or may be irrelevant, out of date, inappropriate or objectionable in any way whatsoever or in respect of which Jazz receives any complaint (whether valid, justified or not).

If you upload, post or otherwise transmit any Content to a public part of this Website or any Jazz Site (including, without limitation, if you post a message to a bulletin board or chat forum, upload files, input data, or engage in any other form of communication through this Website or any other Jazz Site) you are wholly responsible for it. Any content, information, data, text, music, software, sound, photographs, graphics, video, messages or other materials that may be posted, emailed or uploaded (in public or privately) for use in the magazine, is only done so in the knowledge that information submitted has full copyright by the supplier, and/or that they have been granted permission for the use of said content. Jazz does not take responsibility for any content used or unused that does not have the correct usage permission and that all responsibility falls to the originator of the content.

5. Links To Third Parties

This Website and other Jazz Site may contain links to websites operated by third parties (“Third Party Websites”). Jazz does not have any influence or control over any such Third Party Website and, unless otherwise stated, is not responsible for and does not endorse any Third Party Website or its availability or contents or any agreement or understanding you enter into with a third party through a Third Party Website.

6. Member Conduct

You agree that when using the Website or any other Jazz Site you will not:

a. Upload, post or otherwise transmit Content which violates the rights (including, without limitation, the intellectual property rights) of a third party or which is unlawful, harmful, threatening, abusive, argumentative, hateful, offensive (whether in relation to sex, race, religion or otherwise) harassing, defamatory, vulgar, obscene, indecent, libellous, invasive of another's privacy or contains any illegal content;

b. Harvest Content or IP addresses or upload, post or otherwise transmit any Content which contains software viruses or any other files or programs that may interrupt, destroy or limit the functionality of this Website or any other Jazz Site or any networks connected to this Website or any Jazz Site or another's computer, or that contains any chain letters, pyramid-selling schemes, bulk mail, junk mail or similar; or

c. Upload, post or otherwise transmit any Content for any commercial or business purpose including (without limitation) any Content which contains any advertising or promotional materials; or

d. Restrict or in any way inhibit any person from using this Website or any Jazz Site;

You acknowledge that you are solely responsible for maintaining a secure password for the purpose of gaining access to the member sections of this Website or any other Jazz Site.

You agree to indemnify Jazz in full and on demand from and against any loss, damage, costs or expenses which they suffer or incur directly or indirectly as a result of your use of this Website or any other Jazz Site other than in accordance with these Terms and Conditions.

If you provide information to Jazz on or through this Website or any other Jazz Site, Jazz will use it in accordance with the terms of its privacy policy. That privacy policy forms part of these Terms and Conditions and by using this Website or any other Jazz Site you acknowledge and agree that you have read and accept the terms of that privacy policy.

If Jazz is liable to you directly or indirectly in relation to this Website, any other Jazz Site, any Third Party Websites, links to Third Party Websites, the Material, Content, or any products or services offered on or through this Website or any other Jazz Site or Third Party Website, that liability (howsoever arising) shall be limited to the sums paid by you in consideration for Jazz granting you membership to this Website.

Nothing in these Terms and Conditions shall be construed as excluding or limiting the liability of Jazz or its group companies for death or personal injury caused by its negligence or for any other liability which cannot be excluded by English law.

9. Access Restriction

Jazz reserves the right in its sole discretion to deny you access to this Website or any Jazz Site, or any portion thereof, without notice and for any reason including, without limitation, if you fail to comply with any clause 5 (Member Conduct) or any other provision of these Terms and Conditions. In particular, Jazz may deny you access to this Website or any other Jazz Site if Jazz exercises its right to lock any discussion topic to prevent further discussion, following submission of Content relating to that topic by you.

10. Refunds

Cancellation of an order: All orders are fully cancellable as long as the cancel request is received within 48 hours of the time the order is placed. After that, in most cases, cancellations will not be accepted.

Sold out / out of stock items: If Jazz Fashion Publishing Limited has sold out of items or has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible and, if requested, any sum debited by Worldpay from your credit/debit card will be re-credited to your account. The refund will be made as soon as possible and in any event within 30 days of your order. Jazz Fashion Publishing Limited will not be obliged to offer any additional compensation for disappointment suffered. Under no circumstances will Jazz Fashion Publishing Limited's liability extend to more than a full refund. This does not affect your statutory rights.

Faulty Goods: If the goods ordered are received faulty, please contact our administration dept within 7 days of the order being received, where we will provide you with a Freepost address of where to return the items Once these have been received, a replacement will be sent out immediately.

Returns:

Merchandise: If for any reason you are unhappy with merchandise you have purchased from us, please contact us within 7 days of receiving the item(s) where we will provide you with a return address. *Once these items have been received a refund will be made*. NB. Any items that are returned will only be refunded if they are returned in their original packaging and are unused/unworn.

Postage and Packaging costs will not be refunded.

*Proof of posting is not proof of delivery. It is recommended that any returns are sent by recorded delivery or special delivery to enable the package to be tracked.*

Subscriptions: Refunds are not available for our magazine subscriptions.

11. Online Competitions

If you take part in any competition which is run on or through this Website or any Jazz Site ("Competition"), you agree to be bound by the Online Competition Rules and any other rules specified by Jazz from time to time ("Competition Rules") and by the decisions of Jazz, which are final in all matters relating to the Competition. Jazz reserves the right to disqualify any entrant and/or winner in its absolute discretion without notice in accordance with the Competition Rules.

12. General

These Terms and Conditions (as amended from time to time) constitute the entire agreement between you and Jazz concerning your use of this Website or any other Jazz Site and supersede any previous arrangement, agreement, undertaking or proposal, written or oral between you and Jazz in relation to such matters. Jazz reserves the right to update these Terms and Conditions from time to time. If it does so, the updated version will be effective as soon as it is uploaded on to this Website. No other variation to these Terms and Conditions shall be effective unless in writing and signed by an authorised representative on behalf of Jazz.

These Terms and Conditions shall be governed by and construed in accordance with English law and you agree, for the benefit of Jazz, to submit to the exclusive jurisdiction of the English Courts.

If any provision(s) of these Terms and Conditions is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties and all other provisions shall remain in full force and effect.

Jazz’s failure to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Jazz in writing.

Unless otherwise expressly stated, nothing in the Terms and Conditions shall create any rights or any other benefits whether pursuant to the Contracts (Rights of Third Parties) Act 1999 or otherwise in favour of any person other than you and Jazz.

Service Fees

What’s the difference between the Service Charge, Processing Fee and Delivery Cost? Service charges are applied per ticket and not all tickets will necessarily have one.  Order processing fees and delivery costs, are applied once per order, regardless of the quantity of tickets being purchased.

Why are these charges levied? These charges pay for our credit/debit card processing services, merchant fees, distribution network, installation and maintenance of computer hardware and software, telephone lines, labour and all the other costs associated with a ticket transaction.

If delivery costs are incurred, these will be included as either a processing fee or delivery cost.

How much are these charges and fees?  We negotiate our charges with venue operators, promoters and others based on the costs involved in both their presentation of the event and our services with respect to the ticketing of their events. The actual amount is determined by agreement with the venue or promoter for each event.


Group Bookings
It’s rare for us to be able to offer group booking discounts. However, if you have a large group of people who want to attend specific event please email [email protected] including the number you require to book and the event you wish to attend.

Magazine Subscriptions

  1. Contracting Party. Your subscription contract will be fulfilled by Jazz Publishing Limited t/a Jazz Publishing, a company registered in England and Wales under registration number 3743871 whose registered office is at 1 Marcher Court, Sealand Road, Chester  CH1 6BS
  2. When the subscription contract is formed - If placing your order on-line your credit/debit card will be debited when you click “Submit order”. Although you will either see a page or receive an email if you have supplied your email address acknowledging that your order has been received successfully and is being processed, the contract between us is not formed at this point. A legally binding contract is formed on the date we send you written confirmation of your order.

    When you fax, post or telephone us with details of your order, you are making an offer to take out a subscription which, if accepted by us, will result in a binding contract.

    You will receive this written confirmation within 14 days of submitting your order in the form of an email confirmation or an acknowledgement letter. We will not be responsible if you fail to receive the written confirmation because you have supplied us with an incorrect postal address or email address.

    We reserve the right not to accept or process your order for any reason. All orders are subject to validation checks and authorisation by your payment card issuer. If we do not accept your order and your credit/debit card has already been debited, we will notify you and refund your card in full immediately.
  3. Right to refuse orders. We reserve the right not to fulfil and to cancel orders:
    1. In the event of obvious inaccuracies in prices, except that we may fulfil your order at the correct price;
    2. If we are unable to obtain payment authorisation from the issuer of your payment card.
  4. Subscription Delivery. We will deliver the magazines to the address you notify to us when you place the your order. Orders purchased as a gift before December will start with the February issue published in January. All gift orders purchased as a gift after this date will begin with the first available issue. Orders purchased for yourself will start with the next available issue - please allow up to four weeks for delivery.  Delivery timings will depends on the timing of the order and the frequency of the magazine publication. You agree that we will not be responsible for failure to deliver the magazines if you have supplied us with an incorrect address. We reserve the right to dispose of incorrectly addressed envelopes and their contents without an obligation to refund you or any other person if they are returned to us and despite efforts to contact you we do not receive correct address details.
  5. Delay in Delivery and Non-delivery. We will not be liable to you for any delay in delivery or non-delivery of magazines in the following circumstances:
    1. Where the issuer of your payment card refuses to authorise payment to us;
    2. Where such delay or failure is due to circumstances beyond out control or the control of our subcontractors and agents, including but not restricted to war, electricity power failure, utilities failure, failure of telecommunication links, failure of transport infrastructure, fire, flood, government act, act of God, legislative constraints, strikes, labour disputes or malicious damage involving employees.
  6. Cancellations and Refunds. Where a minimum term of 12 months is advertised, cancellations are not permitted until the end of this initial period and we will not issue a refund. Should you wish to cancel after the minimum term, please contact our customer care team in writing.
    1. For all other subscriptions or after the minimum term of your subscription, you may cancel your subscription contract at any time by notifying our customer services team in writing. We will refund you the cost of the issues not yet issued to you at the time you notify us of your wish to cancel.
    2. Credit Card Refunds. Please note that all credit card refunds will be issued in GBP Sterling. Your credit card company will convert the sterling amount into your local currency and may charge additional fees for completing the transaction.   7. Price Information. Prices displayed on the subscriptions section of the website will prevail at all times in relation to the orders placed online. Prices quoted on screen include delivery charges and taxes (where applicable).

    You either make a one-off payment for a one or two year subscription or make ongoing direct debit payments for any other subscription term. If you make ongoing direct debit payments we reserve the right to increase our prices at any time after the first year of your subscription has elapsed and will notify you in writing within 10 days notice of any such price increase.

    Although we try to ensure that all prices are accurate, errors may occur. If we discover an error in the price of your order, we will inform you as soon as possible. You will have the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. We will refund you in full if you cancel your order and have already paid.
  8. Credit Card Payment. If you are under 18 or are not using your own credit/debit card to pay for the subscription, you must ask the permission of the credit/debit card holder before entering the payment details. By clicking “Submit” you are confirming that you have obtained the express prior permission of the credit/debit card holder.
  9. Liability. Our liability to you in the event of the magazines being lost in dispatch shall, at our discretion, be limited either to replacement of the missing issues or refund of the cost of the missing issues.

    To the extent permitted by law we exclude all other liability to you. Our exclusions of liability shall not apply to any damages arising from death or personal injury caused by negligence or that of any of our employees or agents.

    These Terms and Conditions do not and shall not affect your statutory rights as a consumer.
  10. Third Party Rights. A person who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce or rely upon any provision of them.
  11. Use or Personal Information. We use the personal and transactional information (e.g. name, address, email address, credit card details) (“Personal Information”) you supply us in order to fulfil your subscription order.

    On the online order form we will ask you about receiving details of ‘our’ products and services that may be of interest to you. You should tick the relevant boxes to indicate whether or not you wish to receive such information.
  12. Unauthorised Access to Personal Information. Unless a member of our staff has been fraudulent or negligent, we will not be liable to you for any losses you may suffer as a result of unauthorised access by a third party to the information (including in particular credit/debit card details) you transmit when you place an order. It is your responsibility to ensure the security of your own credit/debit cards to avoid unauthorised use.
  13. Cover Mounts. If any of our magazines are put on sale in the UK containing a cover mount gift, you are not guaranteed to receive these cover mounts or supplements. Magazines delivered to overseas addresses will not contain a cover mount gift.
  14. Variation. These Terms and Conditions are subject to change.
  15. Prize Draw and Competition Rules. All prize draws and competitions, which are associated with our magazine subscription offers are subject to separate terms and conditions. For the avoidance of doubt, such prize draws and competitions, these are only open to you if you are able to supply us with a billing address in the UK.
  16. Gift Subscriptions.  A gift card will be sent to you to pass on the gift recipient. Once you’ve placed your gift order, you’ll receive a postal acknowledgement within 14 days plus allow an email acknowledgement within 24 hours (if you gave us your email address). Please allow up to six weeks for delivery of the first subscription issue for both the UK and Overseas orders.
  17. Subscription Rates in $ and €. The prices quoted in $ or € are an approximate figure. All credit cards will be debited in Pounds Sterling by your bank or building society on behalf of Jazz Publishing. Jazz Publishing shall convert US Dollar prices at the rate of exchange published by our bank, Barclays PLC on that day. Jazz Publishing shall convert Euro prices at the rate of exchanged published by our bank, Barclays PLC on that day. Your bank or building society may apply a different exchange rate to that applied by Jazz Publishing to convert the Pounds Sterling amount to your local currency and/or change an additional fee for the transaction.
  18. Subscription Gifts.
    (1) From time to time Jazz Publishing will run subscription offers on its titles for new subscribers that may include incentive gifts. These gifts will not be available for magazines delivered to Overseas addresses.
    (2) Gifts are subject to availability and strictly limited on a first come first serve basis.
  19. Subscription Term. If the magazine ordered changes frequency per anum, we will honour the number of issues paid for, not the term of subscription.
  20. Governing Law and Jurisdiction. These Terms and Conditions are governed by English Law. You hereby irrevocably submit to the exclusive jurisdiction of the English courts notwithstanding the jurisdiction where you are based.
  21. Entire Agreement. These Terms and Conditions override any contrary terms or conditions published by us in relation to any order placed by you with us.
  22. Subscription Term. If the magazine you have subscribed to changes frequency per annum, we will honour the number of issues paid for but not the term of the subscription.

Your goods have not arrived – We aim to dispatch our products as soon as possible and we aim to do this within three working days.

Cancellations, Refunds and Exchanges
