UK COURTS have ordered British ISPs to hand over the names and addresses of file sharers to the record industry.

The High Court move gives legal backing to the British Phonographic Industry’s moves against file sharing pirates. More than 31 individuals' details will be given to the BPI under the current court order.

According to the BPI, the move means that courts have accepted that file sharers in the UK are infringing copyright. The order for disclosure means that the ISPs concerned have 14 days in which to give the BPI the names and addresses of the 31 broadband account holders, it thinks were uploading files.

Usually you don't give names or addresses when you sign up for a P2P. You log in under a psudenim and that is who you are ie Wankstar123 or whatever. That's why peeps use them in the knowledge that they are not registered anywhere. Obviously there are ways of tracing some peeps and heads will roll. Can't see how they can be tried retroactively, as there was no ruling before.....

U missed the point - its your ISP thats doing this not the file sharing servers !!!

Your ISP has your IP address which with broadband is tracable to your phoneline. I have done some work for ISP's in the past and I have seen this information logged onto a pc. Also it is possible for each ISP to log everysite you have been to (this is how most peodophile rings are cracked).

its very easy for ISP's to collate this info as well, they just have one of ther servers pickout words like mirc, winmx and other P2P progs. log all the people using them and now are being forced to hand this info over. As you have to share your stuff to others using P2P then you ar eclassed as a server

unfortuantly that wont stop your ISP being able to log your isp and the P2P prog - it will however stop them from being able to see which tracks/albums youre downloading - but not the activity

agreed
but the companies would have to contact the isp first with a specific ip address, they believe is commiting these acts.
the ISP wont be activly monitering who uploads what to where etc....and are ubder no legal obligation to do so either

so unless you let your ip addres slip to the relavent party (and dont forget they needed to prove to the courts first that the specific address was guilty of the offence before name are to be released)

it is higly unlikly that they would pursue downloaders unless the downloads were excessive and.
and even then you could plead that you have an original copy of the album software etc..and the download was for back-up purposes (obviously if caught you would have to rush out and buy a real copy as proof)

Wannado, my ISP give me a nice new IP address everytime I re-boot...
Very nice of them too, considering the amount of traffic going through my account (both up and down )
but sometimes a static Ip is required for "certain" things and thats where No-Ip.com comes in...a free url redirector, to whatever ip address you specify......

Ohh !! The Joys Of The Internet !!

Yes and I can see them taking how many million ppl to court???

The police in the UK are a damm sight more concerned in tracing peadophile and porn rings that they are in persuing ppl copying music (if you are using it for porn then tough !!)

Scare tactics thats all ...........

the ISP wont be activly monitering who uploads what to where

all ISP's do actively monitor all there customers usage - thats how all the stats come to life. I have also done work on the servers of 3 major ISP's here in the uk and they all monitor each connection and store that data for 6 months (as required by british law). Also another angle is this capping of broadband & cable that is now in force (or coming into force) all activity is monitored and kept, that is how the capping works.

Granted ISP's arnt gonna give this info out willy nilly but if requested to they now under law have to pass this information on. (just like the rest of the new sh*te laws mrs blairs passed). Also if any uk fraud/theft/pirate agency has gona as far as requesting an IP address with details of usage - then they almost certainly have the case sown up.

UK COURTS have ordered British ISPs to hand over the names and addresses of file sharers to the record industry. I know BT (allegidly) is one of these.

The High Court move gives legal backing to the British Phonographic Industry’s moves against file sharing pirates. More than 31 individuals' details will be given to the BPI under the current court order. this problem has been made worse by the boom in MP3 technology and the general acceptance that the person downloading is not doing any wrong.

even this humble forum has your isp logged, as do all other websites/forums were you have to sign in.

even dial up services or isps that give revolving ip's are not emune as these are assigned by the loggin name and if you right them down you will in fact see that you will be issued 1 - 50 (dialup 1 - 10 ) ip numbers.

Now i like most used to download music - in fact if im 100% honest uptill a few years ago used to download films, games, music and expenssive apps programs, but after working in with some ISP's on the IT side and asking some questions now do not take the risk.

you may continue t get away with it and good luck to you, but i'm not prepared to risk loosing the 6 pcs in my home alomg with hefty fine or worse a prison sentence.

You CAN be totally safe if you use the DC++ network, Providing that you only use private Hubs...They can see you down/uploading but without the address/login/password they just cant tell what that data is...
Sure they might have an Idea, but they cant prove anything.

I'm a member of two private hubs..with about 60 odd terrabytes of stuff available to the members, I share about 300 gigs of stuff on them and never a problem, either for me or others on the hubs....

Erm.....just a thought ......but who would they take to court? Not the downloader! thats for sure! The one committing the "offence" is the one offering the copywrited materiel! Erm....BUT......as they could argue they only installed a program to download stuff from the web themselves, the prosecution would have to prove they "offered" copywrited materiel of their own on purpose! ..........hmmmm! I know wot I mean but im a bit .........addled at the mo! :o
