Does the crime fit the punishment?
A Kenyan court has sentenced two men to death by hanging after they were found guilty of stealing a mobile phone. John King'ori Wachira, alias Manga, and John Maina Mwangi, alias Blackie were found guilty last week of breaking into a home, terrorizing the owner and stealing a mobile phone and about US$7 in cash. They were armed with a toy pistol and some other crude weapons.
Following a tip off, local police raided the house where the suspects lived and recovered the cell phone.
The magistrate said during sentencing that the law did not offer an alternative sentence for violent robbery.
There hasn't been a death sentence carried out in Kenya since 1987 when 12 failed coup leaders were hung.
The sentence could be commuted to live imprisonment, as the current Kenyan president, Mwai Kibaki commuted 195 death sentences to life imprisonment following his election victory last December.

A guy in York was arrested a while ago for going to hospitals in the area and asking for donations of theatre gowns and masks - said he was from an amateur local dramatics group or something...
Anyway, turns out they were for his own personal use...he has a fetish for stuff like that.... (well, whatever rings your bell, I suppose...)
Well apparently, he was jailed for 3 years this week....
Not sure exactly what he was convicted for...(my other half knows the details), but, FFS....
3 YEARS FOR A FETISH???????
Justice clearly at work here....
'course, none of us would be found guilty of having fetishes would we??? No, of course not...

back to the robbery, it was a violent attack with a gun..even if the gun was fake i am sure the person on the other end of the attack didnt know, think about this, if it was your wife, daughter, grandma who was attacked in their own home by a man or men with a gun, would you want the death sentance?
i personally think anyone who breaks into ya house with criminal or violent intent should be locked up for life,,, it makes no difference if he stole a fone or a million quid, the breakin and resulting terrorisation was the same.
as far as the fetish guy is concerned, i doubt he was arrested for having a fetish, he was proberbly locked up for obtaining stuff under false pretences...imagine if he had put them on around the hospital and decided to opperate on someone,,,it has been known,,,,
I'd better stop visiting the candle shop then!

uhm, no...back to the fetish thing...
If there had been any indication that this was the case, he would have (deservedly) got a lot more than 3 years; I think that goes without saying.
As it was proven that it was purely for his own (weird, perhaps, but harmless) sexual delight in his own home - and he wasn't wandering the corridors with a nice, new set of highly sharpened scalpels - I personally think that 3 years is a bit top heavy for trying to con some clothes...whether under false pretences or not!
Heaven forbid any of us should ever try to obtain anything under false pretences, eh? :eek:

Does anyone remember the story of a south african bus driver who stopped somewhere to have a piss?
He had a bus load of mental patients who whilst he was gone did a runner.
He came back to his bus and in the fear of losing his job he just stopped at a public bus stop and filled his seats up, then drove to the mental institute.
Of course all the passengers where getting sedated whilst trying to make out they where quite normal..
It took over a week for the authorities to figure out what had happened..
It was on the news last year on Radio 1.
