Landlord fined over smoking ban
Hamish Howitt pledged to carry on allowing smoking
The first pub landlord in England to be prosecuted for flouting the smoking ban has been fined £500.

I went to a punk/oi gig on Saturday and there were loads of people smoking openly in there. I don't think the man from the council was too keen to come in and tell a couple of thousand drunk skinheads that they shouldn't be smoking ;)

I think this law could be easily scuppered nby everyone who wants to smoke in the pub chucking a fiver in a smoking kitty on that particular night. Once the kitty's full enough to pay the fine, get yer fiver back at the end of the night if the smoking police don't come in, lose it if they do, everyone's a winner then.

500 quid fine, plus 2 grand costs, that means that he is going to need 500 people through his door every night, all of whom must smoke, and are prepared to pay up. problem is that he can defy the law as much as he wants, but pub licences arent forever, and the first thing that the magistrate who grants the licences will ask is 'do the police have any objections to the renewal of this licence' allowing smoking to continue in your pub after the ban is just another way to end up unemployed. speaking as a non smoker, i say good!1 let the ban continue, all the smokers can go stand in the street and i can stay indoors where its smoke free. ive had to endure smoky pubs for over 20 years, so, let me have my 20 odd years of fresh air in the pub, and then we can say we're even, and then re-negotiate the ban if you like. sounds fair to me. whenever ive been bothered by smoke in a pub, the answer i always got from smokers was "if yer dont like it, go outside then" so i cant see how they can complain now, theyre only following their own instructions.

and i would have thought that an mc clubhouse would be classed as a private members club, so wouldnt be covered like a public bar.

I actually agree with not smoking in pubs,etc. I spend a lot of money on my (that's MY) fags, and don't wanna share em with a load of freeloading gits that can't be arsed to buy their own!

Point is with smoking and non smoking bars people could exercise there right of choice.
Now there is no choice and even non smokers like my daughter hate it.
Everyone is outside and the pub is empty cos the non smokers have to go outside with the smokers are sit looking at the walls.
Me i smoke when i am out,only then,i love the ban.
I just stay outside and every 10 mins or so there is someone new to talk to.
But i hate anyone telling me what to do. :mad:

So bugger it, I been breaking the law :DMy understanding is that it's not based on the clientele, but on the workforce. Therefore a bar of any sort with employees (or any workplace) has to comply. A bar which is not open to the public and has no employees (not a workplace) probably doesn't.
Then again, there could be clauses so that volunteers in a mutual society can be regarded as employees for the purpose of the Act.

Bars aboard ship, as in all parts of the ship (including individual cabins) are parts of a workplace - that's why our smokers now have to go out on deck to smoke.

that'll be me cruising holidays over and done with then :D

I was quite shocked when we stayed at a hotel in London recently, to be offered the choice of a smoking or non smoking room. Really didnt think they would allow it in any part of the hotel.

Nail down the political arseholes that brought in the ban and stub a fag out in thier eye.

All that is needed is for a bit of respect and consideration both ways to be exercised by both smokers and non smokers. We are all adults and do not need some fuckwit PC asshole telling us what to do, even in our premises.

Nobody comes into my workshop without an invite. I smoke and if visitors do not like that, they are free to NOT enter.

Got to go, off seal clubbing in the morning after microwaving the kitten.

sheesh, all that agression, do you need to pop out for a smoke or something? :D

personally, im glad of the ban, the pubs are now smoke free, and thats a major change to how much i enjoy going out now, its loads better. as for smokers having to go outside? well, if im honest, all i can think is, fuck em. ive had to go outside if i didnt like it for 20 odd years, theyve had to do it for a few weeks and theyre bleating like fuck allready. i couldnt care less. ive seen what smoking does to people, and have no desire to inhale any more of it than i have to. its their drug addiction, and i want no part of it. why is it suddenly a civil liberys issue now that the roles are reversed? i never heard any smoker stand up for my right to breath smoke free air before the ban.!! :rolleyes:

Well I don't tend to frequent public house that offten, i use my local from time to time, on a Sunday evening and there we all are stood outside including the landlord having a smoke, no fecker in the bar!

I wonder if given the choice how many landlords would have gone smoke free ;)

we have a trading estate not far from us and I have to go through it to get to supermarket. since the smoking came in, dont matter what time of day I go through, no matter what the weather, you can see loads of peeps outside having a smoke. wonder how much work time is lost now that the ban is in place and at what cost to inudustry.

as for pubs, I dont go in them now, not because I cant go with a smoke but because I refuse to be dictated to.
