OK A good mate of ours dad died few weeks ago, his mother has a couple of illnesses including MS so him and his wife decided it would be better that they move in with her , so they could look after her(3 bed council house that she shared with her hubby for over 25 yrs) rather than move her in with them (own home but 2 up 2 down with little room)
Then they enquired about possibly buying his mums house, he couldn't so they thought that his mum would beable to.... council says, "oh no she can't buy it as the rent book wasn't in her name, it was in hubbys name"!!!! so they say "OK we will move in with her anyway so we can look after her" Council says, "oh no you can't as she doesn't need that house anymore, we need it for families, we will move her out"!!! my friend says, "well how can we look after her then?" council says, "don't worry we will get social services to look after her"!!!!...................

I say what a fecking society we live in, how can they move her now when shes ill herself and just lost her husband who shes been with all her life, her only son wants to look after her in her home etc etc etc rant rant rant gggrrrrrrrrrrrrr :mad: :mad: :mad:

I know this will start the ball rolling again but you can bet the family that they'd move in would not be of British origin.
My sympathy to your mates and their family. I've just lost my mom and its a bastard.

What total and utter crap!!!! how much is it going to cost social services to look after her, bloody thousands every year. Problem with officials is they have no utter common sense whatsoever. Sorry to hear about your mum TD.

I would dearly love to meet one of these "council planners" that makes these decisions! I mean, do they actually live their lives like the way they make their decisions? They are probably all self-centred, bumptious little gits with a "Me, Me, Me!" attitude, and don't give a fcuk about anyone else!

And I bet they are Born Again Christian Veggies, with PC values that drive 2CVs or Morris Minors! Oops sorry in this day and age it would prpobably be a Toyota Yaris or one of them cheap New cars that you can buy now. Or more than likely, they drive a poxy 4X4 or MPV and take half the kids in the neighbourhood on the school run! Then go to work and try to expunge their work values onto their collegues! And make crass, petty decisions that badly effect every other mere mortals so that they can justify their own pathetic born again existence!

Please! If anyone on here are Born Again Christians, don't tell me okay? I value your friendship more that your religion!

my cousin used to work in a housing office.. had to get out.. was not allowed to use common sense

I think he should just move in and apply to have rent book in her name, council won't have a leg to stand on cos they'd all be living there and would need the extra rooms. Council can't move her out unless she stops paying the rent, it's up to the council to try and evict her and they won't be able to cos most courts would see the 'human' side to it. She should threaten to take council to court if they won't change the tennancy name to hers, by definition it's hers anyway cos she's lived there for 25 years, they are trying it on methinks, bet it's a nice area with a big waiting list..?

tell him to see a solicitor cos she will have rights.

Yep - get a solicitor on it.
They tried it with me - house had only been in the ol' mans name, not a joint tenancy with the ol' lady.
I think there's a 'succession of tenancy' rule for such cases.
The council will try to get you to apply as a 'new' tennant - don't fall for this one, if you do, and then decide to buy the house, any discount accrued over the years will count for nothing because you're new tenants.
I've found, with our council, most cock-ups are due to incompetence, rather than any mailicious ill will on their part.

i do'nt exactly know what this ladies rights are, but she will have a tenency agreement with her local council. i suspect the council does have the right to evict, i know, because i have to be at a property when a tennant is evicted and it's not nice. wish her well.

Someone from uni recently invited me over to their flat for a coffee. No sooner had I got there she put on this blood curdlingly soft album which was all, "I love you Jesus, my wonderful saviour" crap. Then proceeded to bore me for the next half hour about how Jesus changed her life, is so wonderful etc etc when in fact she's the most miserable, wretched, lonlely and sorry arsed woman I've ever met and I only went over there because I felt sorry for her.
I just sat there rocking back and forth with my hands over my ears before making a run for it.
What people like that need is Paganism, nude frolicking, a shag and several bottles of JD :D oh yes, and a few bike rallies.

Tell your friend that their mum has a legal RIGHT to succeed the tenancy from her deceased husband and is the legal tenant of the house. The only way the council can end her tenacy is by obtaining a court order for possession. This can only be obtained on certain grounds (ie. where certain conditions of tenancy have been broken) They can only force her to move to another property if the one she is occupying is specifically designed or adapted for disabled (or elderly) people and there are no such people now living there.

On purchasing, as the legal tenant she has the RIGHT to buy and her discount will include (in full) the qualifying years of her former husbands tenancy, which she has succeeded. Normally a tenant can co-purchase a dwelling with other family members as long as they still have at least 25% interest in the property.

Do not accept the councils word on all this - go to your local Citizens Advice Bureau or Law Centre and get advice.

It's about council tenancy.

Also go to citizens advice or get a solicitor on it, As far as I can tell they have been giving out the wrong information. There is a right of succession (sp?) for council tenancies.

Also get the local councillors on to it too, if they are good they will like something juicy to get their teeth into. :) They like jumping on the council if they think its not acting right. (well ours do anyway)

They need to get the local press involved aswell.There's nothing a local paper likes more than a bit of council bashing.

Thankyou all for your support, I passed all this info onto him and he has been to see local councilor etc and everything is going great, he's now not worried anymore. :):)
